EU re­port­ing ser­vice for the trans­fer of firearms

This task was trans­ferred from the Fed­er­al Crim­i­nal Po­lice Of­fice (BKA) to the Fed­er­al Of­fice of Ad­min­is­tra­tion (BVA) on 6 Ju­ly 2017 by the amend­ment of the Ger­man Weapons Act.

The Coun­cil Di­rec­tive 91/477/EEC of 18 June 1991 obliges EU Mem­ber States to de­ter­mine cen­tral con­tact points and to re­port in ad­vance any trans­fer of firearms to oth­er coun­tries via these au­thor­i­ties (so-called EU re­port­ing ser­vices). The ob­jec­tive is to make weapons trade with­in the Eu­ro­pean Union trans­par­ent.

This di­rec­tive has been trans­posed in­to na­tion­al law through sec­tions 31 (2) as well as 34 (4) and (5) of the Weapons Act (Waf­fG) in con­junc­tion with sec­tions 31 and 32 of the Gen­er­al Or­di­nance on the Weapons Act (AWaf­fV). Ac­cord­ing to the stat­ed pro­vi­sions, the Fed­er­al Of­fice of Ad­min­is­tra­tion is the cen­tral Ger­man con­tact point for EU re­port­ing ser­vices and, with­in Ger­many, for Land crim­i­nal po­lice of­fices, lo­cal weapons au­thor­i­ties, busi­ness­es and pri­vate per­sons.
